ST. PANCRAS CATHOLIC PRIMARY SCHOOL

 

INSTRUMENT OF GOVERNMENT

 

The name of the school is St. Pancras Catholic Primary School.

 

The school was founded by and is a part of the Catholic Church. The School is to be conducted as a Catholic school in accordance with Canon Law and the teachings of the Catholic Church, and in accordance with the Trust Deed of the Diocese of East Anglia and in particular:Religious education is to be in accordance with the teachings, doctrines, discipline and general and particular norms of the Catholic ChurchReligious worship is to be in accordance with the rites, practices, discipline and liturgical norms of the Catholic Church

      And at all times the school is to serve as a witness to the Catholic faith in Our Lord Jesus   Christ.

 

The school is a voluntary aided school in the trusteeship of the Diocese of East Anglia and is an exempt charity for advancing the Catholic religion in the Diocese by such means as the Bishop thinks fit and proper.

 

The name of the governing body is: The Governing Body of St. Pancras Catholic Primary School

 

The governing body shall consist of:

      Seven foundation governors

Two parent governors

One headteacher

One staff governor

One Local Authority governor

No more than two co-opted governor (Y)

 

The total number of governors is 12+Y

 

Foundation governors shall be appointed and may be removed by the Bishop of East Anglia (or any person exercising ordinary jurisdiction in his name, including, where the See is vacant or impeded, the person or persons on whom governance of the See has devolved).

 

This Instrument of Government comes into effect on 1st September 2015.

 

This Instrument of Government was approved by the Diocese of East Anglia on the 17th July 2015 and made by order of Suffolk Local Authority on the 22nd July 2015.

 

A copy of this Instrument of Government must be supplied to every member of the governing body (and any headteacher if not a governor) and the Diocese of East Anglia.

 

It is recommended by the CES that where a school needs additional governors to augment its skill set, then it should co-opt. The total number of co-opted governors, when counted with the headteacher and staff governors, must not exceed one third of the total governing body membership.

 

This means that St. Pancras could appoint no more than two co-opted governors.

 

The status of the school’s governing body

 

“Governors have a legal responsibility to ensure that the school, in all its aspects, is managed and organised in the light of Christian values and the teachings of the Church.” 

 

The Governing Body has charitable status. It is also corporate, which means that it has a separate legal identity from that of its members. This effectively protects individual members from personal liability. Individual governors are volunteers. They receive no payment whatsoever and, although they can legitimately claim expenses against school business, no St. Pancras governors do so. As individuals, governors have no power or right to act on behalf of the governing body, except where the whole governing body has delegated a specific function to an individual.

 

Governors are required to meet in full session at least once per term. Ours meet twice per term; that is, six times per school year. Governing Body sub-committees and working groups meet more often, especially those relating to Personnel, Finance, and Curriculum & Standards. All meetings are properly minuted and recorded. The school maintains a Governing Body minute book available to parents who make a request to see it.

 

As St Pancras is a voluntary aided school, it is also the employer, unlike county primary schools for whom the local authority is the employer. This means that the Governing Body at St. Pancras has very particular duties and responsibilities in relation to staffing appointments and personnel management. It also has statutory duties and responsibilities in connection with admissions, the school’s finances, the premises, equal opportunities and discrimination legislation, standards, inspection, the curriculum, reporting to parents, discipline, special educational needs, attendance, health, safety, safeguarding, school security and welfare.

 

“As good employers, the governors of a Catholic school will fulfil all the requirements of employment law. The law allows governors to assure themselves that their employees have a clear understanding of and commitment to the teaching of the Church.” [13] In fact, in terms of religious instruction, the diocesan bishop has responsibility to see that they are outstanding in respect of knowledge of correct doctrine, the witness of Christian life and teaching skill. Moreover, the bishop has the right to remove such teachers if a reason of religion or morals requires it.

 

Governance and executive accountability

 

The school – its governors, leaders, managers and other staff – is differentially accountable to the Catholic Church (more specifically, to the Diocese of East Anglia), to national government and to its pupils and their parents and carers. However, an institution founded on the Trinitarian God, understanding its existence wholly in terms of the person of Jesus Christ, cannot define its accountability solely by reference to its human context. Ultimately, St. Pancras Catholic Primary School as a part of the Church is accountable to the divine – to God.

 

This is both a sobering and an empowering truth. It is likely to become more so as the almost irresistible secular world, with its shifting ethical centre of gravity, perceives the Church as a reactionary and largely irrelevant relic of an unenlightened bygone age. It is sobering because accountability to God asks more of us than any set of human standards. It is empowering because, however remote God’s perfection seems to us, through the sacrifice of Christ and the reconciliation and salvation we are each offered through the Cross and Resurrection, we are held accountable as created human beings set free. In other words, we will act contrary to the will of God and yet Christ’s arms will remain outstretched to receive us. National government – and Ofsted – may not be so minded!

 

This is the difference between accountability to one who loves us and those who see us merely as service providers.

Full governing body minutes are signed as accurate at every subsequent meeting. These are filed for access on request on the part of parents etc.

There is an expectation that governors will attend all governor meeting, including committees, as appropriate. Absence at a full governing body meeting is given consent or not, as the case may be. Non attendance for three consecutive governor meetings automatically terminates a governor’s term of office

Statutory duties and responsibilities

 

There is no definitive list of statutory duties. However, these are certainly statutory duties:

To ensure that every learner receives the full statutory EYFS, KS1 and KS2 curriculum

To ensure that the school provides teaching of Religious Education and has told parents / carers of their right to withdraw pupils from this

To ensure that the school provides a daily act of collective worship and has told parents / carers of their right to withdraw pupils from this

To ensure that the school has a policy on sex and relationships education and has told parents / carers of their right to withdraw pupils from this

To ensure that the school meets fully the learning and development requirements of the Early Years Foundation Stage

Equality and diversity

To ensure that there are policies and practices to ensure that the school does not discriminate unlawfully against learners, job applicants or staff on the grounds of gender, race, disability, sexual orientation, religion and belief, marital/civil partnership status or age

To ensure compliance with general duties under the equality Act 2010

To ensure that the school publishes equality information and objectives and that progress towards these is reported annually
